The municipality of Coevorden was found to have acted wrongly when it imposed a penalty payment in August 2018 on DDE (Drentse Renewable Energy), a biogas plant that closed in 2019. The Council of State reached the decision in an appeal brought by the municipality, which must repay the entrepreneur €4,500.
