Judges are increasingly deciding to grant asylum seekers residence permits, reportedly to the frustration of the Dutch Immigration and Naturalisation Service (IND). The change followed a judgment by the Court of Justice of the European Union that allows judges to conduct a full review of the IND’s assessment. The IND opposes this approach and is at odds with the Council of State over it.
