Hein Berkelmans appeared before the Council of State in The Hague in another legal dispute with the municipality of Sint-Michielsgestel. The hearing lasted about an hour while the council sought to establish the issue at stake. It was reported that Berkelmans may have a point and that a permit procedure may need to be followed again.

The Council of State found that the construction of the De Groene Villa apartment building in Sint-Michielsgestel would not cause parking problems. It therefore rejected objections by property manager and shop owner Hein Berkelmans, allowing construction to begin. De Raad van State oordeelde dat de bouw van appartementencomplex De Groene Villa in Sint-Michielsgestel niet tot parkeerproblemen zou leiden. Daarmee wees de Raad bezwaren van vastgoedbeheerder en winkelier Hein Berkelmans af en kan de bouw beginnen.
